مع تغاضي الحكومة وتصاعد قوة العشائر:
العراق … جرائم شرف بحق نساء تسجل كحالات وفاة عادية

في صبيحة يوم خريفي من عام 2016، ووسط أكوام النفايات في منطقة «السدة» بأطراف الزعفرانية في بغداد، عثرت الشرطة على جثة (ف، س) الفتاة العشرينية وهي مصابة بعيارات نارية في الرأس والرقبة. وبعد أن سُلمت جثة الضحية من قبل الشرطة الى «الطب العدلي» أخرجها ذووها بشهادة وفاة تؤكد تعرضها الى نوبة قلبية مفاجئة، ما اخفى معالم الجريمة.
شقيقة الضحية، البالغة من العمر 33 سنة، والتي تسكن في بيت من الصفيح وسط الزعفرانية، إحدى ضواحي جنوب شرقي العاصمة بغداد، رفضت في بداية الأمر الحديث عن تفاصيل القصة خوفاً من التصفية الجسدية، الا أنها قبلت بذلك بعد طمأنتها إلى عدم كشف هويتها.
«أولاد عمومتي، هم من قتلوا شقيقتي البالغة 22 سنة بالتواطؤ مع والدي، بعد اكتشاف علاقتها بشاب مجهول»، تُقول شقيقة الضحية وهي تعدل غطاء رأسها الأسود ماسحة بيديها وجهها الشاحب، مضيفة أن أختها حاولت الهرب، غير أن والدها حبسها في غرفة بالمنزل مدة يومين، قَدِم خلالها أولاد عمومتها، واتفقوا على قتلها.
«تدخلت لمنعهم الا انهم هددوني بالقتل أيضاً، وأمام اصراري، قام الابن الأكبر لعمي بتوجيه ضربة إلى رأسي فأغمي علي، وعند استيقاظي، لم أر أختي في المنزل، ولم أعرف بمصيرها إلا بعد يومين، حيث أبلغني والدي بقتلها ورمي جثتها في مكان مجهول».
تهدج صوتها فجأة وملأت الدموع عينيها «بعد مرور أربعة أيام من الحادث، جاء جارنا الشرطي ليخبر والدي بالعثور على جثة شقيقتي في منطقة السدة وتسليمها الى الطب العدلي، فسارع للذهاب الى هناك لإكمال اجراءات الدفن، خشية الفضيحة وكشف ملابسات الجريمة».
في الأثناء، توجّهت شقيقة الضحية الى منزل الشرطي، وأخبرته بأن الجناة هم الوالد وأولاد العم، إلا ان هذا الأخير رفض التدخل خشية من الملاحقات العشائرية وتطور الجناية الى قضية خصومة بين عشيرتين.
بعد يومين نجح الوالد في اخراج شهادة وفاة مغلوطة تؤكد أن سبب الوفاة هو تعرض الضحية «لنوبة قلبية».
على رغم رفض شقيقة الضحية منح كاتب التحقيق نسخة من شهادة الوفاة، خوفاً من اكتشاف أمرها وتعرضها للعقاب، إلا أنها وافقت على اعطائه عنوان الشرطي الذي أخبر العائلة بالعثور على الجثة. أقرّ الشرطي بأن جاره قام فعلاً بقتل ابنته «غسلاً لعاره»، وأن القصة معروفة لدى معظم أهالي المنطقة.
وعلق الشرطي على كيفية تمكن الوالد من اخراج شهادة وفاة لابنته الضحية من دون تعرضه الى المسألة القانونية «تزوير شهادات الوفاة بات مسألة عادية جداً، اذا ما تم دفع المال لذلك، وما فعله جاري هو محاولة تجنب الفضيحة والمساءلة».
وأضاف وهو يشير الى بضعة اوراق أمامه واضعاً اصبعه على مكان الختم والتوقيع «في الكثير من حالات جرائم الشرف، لا يدوّن مسؤولو الطب العدلي في شهادة وفاة المجني عليها تعرضها للرمي بالرصاص أو الحرق، وهي الأسباب الأكثر شيوعاً للوفاة في مثل هذه الحالات، وذلك بسبب حساسية الموضوع الذي قد يعرض سمعة الأهل للتشويه، وكذلك خشية من رد الفعل العشائري».
لا إحصاءات رسمية
قصة (ف.س) هي واحدة من بين عشرات القصص المماثلة لجرائم شرف تُرتكب ضد النساء في بغداد ويتم إلقاء جثثهن في ضواحي العاصمة وتسجيل موتهن على أساس «وفاة عادية» او قتل من قبل مجهولين، في دوائر الطب العدلي. في وقت تخشى الشرطة فتح تحقيقات حقيقية في الموضوع، خوفًا من الملاحقات العشائرية في بلد تتصاعد فيه قوة العشائر متحدية مؤسسات الدولة.
وترفض المؤسسات الرسمية، سواء وزارة الداخلية او وزارة الصحة او الجهات المعنية بالدفاع عن حقوق النساء، تقديم اية ارقام بضحايا العنف من النساء والفتيات، من دون ايراد أسباب مقنعة، مكتفية بالأشارة الى ان الأوضاع الأمنية والسياسية غير مناسبة.
بغياب اية احصاءات رسمية، حول عدد النساء اللواتي يتعرضن للقتل او لحوادث العنف، قام كاتب التحقيق برصد ما نشرته الوكالات المحلية حول جثث النساء المجهولة الهوية التي تم العثور عليها من تاريخ 6/10/2015 ولغاية 21/9/2016 نقلاً عن مصادر أمنية في وزارة الداخلية، بلغ عدد الجثث 52 جثة تتراوح أعمارهن ما بين 20 و35 سنة، غالبيتها كانت مرمية في مناطق جنوب شرقي العاصمة، ومن بينها منطقة الزعفرانية، وكانت تحمل في معظمها آثار إطلاق نار في منطقة الرأس والصدر أو آثار طعن بالسكين.
وهذا الرقم يعد صغيراً جداً، لأن معظم حوادث القتل لا تصل تفاصيلها الى وسائل الاعلام، وفق المحامي دلير حسن، مبيناً أن «ارقام ضحايا العنف من النساء كبير جداً، وهي في تصاعد، وسط ظروف العنف في البلاد والأزمة الاقتصادية، على رغم اصرار الجهات الحكومية على اخفائها».
وينبه حسن الى ترابط ذلك مع تصاعد قوة العشائر وفرضها لأعرافها وإرادتها، في ظل خضوع مسؤولي الحكومة والبرلمان لها، بحكم حاجتهم لدورها في حصد الأصوات الانتخابية.
شهادات وفاة مغلوطة
في زيارة للمستشفى الرئيسي في منطقة الزعفرانية، أخبرت ممرضة رفضت الإفصاح عن هويتها، كاتب التحقيق عن تسلم المستشفى في تموز(يوليو) 2016 جثة فتاة محترقة بالكامل، أبلغ ذووها أنها أقدمت على الانتحار «لكن العديد من كوادر المستشفى علموا من قبل أقرباء الضحية بأن زوجها وأخوتها هم من قاموا بحرقها بعد اكتشاف علاقتها بشخص ما». وأثبتت نتائج دائرة الطب العدلي في بداية الأمر بأن الضحية لم تقدم على الانتحار، لكن بعد ذلك، أجبر الأهل، موظفي الدائرة على تغيير سبب الوفاة في الشهادة ليصبح «الانتحار حرقاً».
روت الممرضة حوادث عدة أخرى، بينها إيصال الشرطة في حزيران(يونيو) 2016 للمستشفى، فتاة تنزف بشدة نتيجة تعرضها لعيار ناري من قبل مجهولين، قبل ان تفارق الحياة متأثرة بالإصابة. «اتضح أن الشرطة عثرت عليها مرمية في التلال الترابية المحيطة بمنطقة سدة الزعفرانية، وبعدها حضر ذووها الى المستشفى وأبلغوا الجهات المسؤولة بأنها كانت مخطوفة من قبل عصابة مجهولة… لكن أم الضحية همست لي، وهي تبكي بصمت، ان أعمامها قتلوها، من دون ذكر أية تفاصيل».
تمكن كاتب التحقيق من الحصول على هاتف أم الضحية والاتصال بها، الا أنها رفضت الحديث عبر الهاتف وأخبرته بأنها ستتصل به لاحقاً لتحديد لقاء حتى تروي له في شكل تفصيلي قصة ابنتها المقتولة، لكن بعد ذلك بيوم واحد، اتصل به رجل عرّف نفسه بأنه قريب لأم الضحية، وهدده بالقتل كما توعد بملاحقته في حال معاودة الاتصال.
شيخ من أهل الزعفرانية أخبر كاتب التحقيق بقصة أخرى، قائلاً إن قريبه «قام بقتل ابنته حرقاً ورمى بجثتها في مكب للنفايات يقع في اطراف المدينة لأنها هربت من المنزل مع شخص تحبه». بقيت جثتها مرمية ثلاثة أيام هناك وبعدها «قمنا نحن أولاد عمومته بدفنها، بعدما استخرجنا لها شهادة وفاة تؤكد أنها توفيت بسبب انفجار قنينة غاز أثناء تواجدها في المطبخ». ويضيف «في البداية، لم يقتنع الطب العدلي والشرطة بذلك، فدفعنا لهم مبلغاً مالياً قيمته 800 دولار، وحصلنا على شهادة وفاة أصولية أُثبت فيها بأنها توفيت نتيجة تعرضها للحرق».
الزعفرانية «مكب الجثث»
تعد الزعفرانية من ضمن الوحدات الإدارية التابعة لبلدية الكرادة في بغداد، وكانت غالبية سكانها من اهالي العاصمة، لكن بعد نيسان(أبرل) 2003، سكنها العديد من ابناء المحافظات الجنوبية والغربية للعراق التي يبرز فيها قوة التأثير العشائري، حتى صارت المنطقة خاضعة لهيمنة الأعراف العشائرية. كما أنه و «بعد حوادث حزيران عام 2014، سكنتها المئات من العوائل النازحة من محافظات الأنبار ونينوى وصلاح الدين»، وفق ما صرّح به أبو علي، أحد وجهاء المنطقة.
و «السدة او السدتين» كما يعرف لدى اهالي الزعفرانية، هي عبارة عن تلال ترابية تحيط اطراف المدينة، ويرجع تاريخ إنشائها الى العهد الملكي، لحماية المزارع من الفيضانات. ومع اقرار النظام الجمهوري في العراق، بُنيت قرب هذه التلال ثكنات عسكرية ومنشآت ومصانع. لكن على اثر دخول القوات الاميركية الى العراق، تحولت هذه المواقع الى مساكن عشوائية وأحياء من الصفيح ومكبات للنفايات ومواقع للمياه الثقيلة، سيما انها أماكن بعيدة عن أنظار الشرطة.
زار كاتب التحقيق منطقة الزعفرانية وتنقل بين بيوت الصفيح، وهناك التقى بثلاثة صبية ممن يزاولون مهنة جمع علب المشروبات الغازية الفارغة.
بلال، ذو الشعر الكث المجعد، والبالغ من العمر 14 سنة، قال بينما هم برمي الكيس الكبير الذي حمل فيه العلب الفارغة عن ظهره، ملقياً اياه عند جزمته الحمراء المهترأة «بين فترة واُخرى نشاهد مع حلول الظلام أو في الفجر، سيارات تقدم الى المنطقة لرمي جثث… ذات ليلة سمعنا إطلاقات رصاص، واكتشفنا في الصباح جثة امرأة شابة مقتولة بعيارات نارية في رأسها».
وفق الأطفال، فإن الشرطة تأتي الى المكان بين فترة وأخرى وتقوم برفع جثث، يتم كشفها من قبل الأهالي أو من العاملين في جمع كل ما يمكن بيعه من مواد ترمى بمكبات المنطقة.
أبو محمد صاحب عربة يدوية يقوم يومياً بجمع القناني البلاستيكية والمعدنية من مكب النفايات المجاور لسدة معسكر الرشيد في نفس المنطقة، ويعثر بصفة مستمرة على جثث للنساء، حتى أنه أصبح شخصاً معروفاً لدى الشرطة في قضية الإبلاغ عن الجثث «اثناء نبشي للقمامة، أعثر أحياناً على جثث… لقد وجدت العديد منها وأبلغت الشرطة… البعض كان مغطى بقطعة قماش او فرشة نوم».
ويضيف «لم يعد الأمر صادماً بالنسبة لي.. انا اتجنب معرفة التفاصيل، لكننا نعلم ان هوية جثث النساء عادة ما تكون غير معروفة، وغالبيتهن يتم قتلهن غسلاً للعار».
الشرطة خائفة
على رغم علم الشرطة بموضوع قتل النساء والإلقاء بجثثهن في السدات ومكبات النفايات، فإنها تخشى من فتح تحقيقات في الموضوع، حيث يقول علي لقمان، ضابط برتبة ملازم اول، مسؤول في دوريات شرطة النجدة (الجهة الوحيدة المسؤولة عن رفع الجثث الى الطب العدلي)، إن «الزعفرانية منطقة يطغى عليها النفوذ العشائري، وبالتالي تخاف الشرطة من اجراء أي تحقيقات، أو البحث عن هوية مرتكب الجرائم ضد النساء، خوفاً من رد فعل القبائل التي ينتمي اليها الجناة».
يرى لقمان ان الطبيعة العشائرية والجغرافية تجعل من سدة الزعفرانية أكثر مناطق بغداد التي يتم العثور فيها على جثث نساء مقتولات رمياً بالرصاص او طعناً بالسكين أو حرقاً بالنار. ويوضح المسؤول الأمني، أن معدل العثور على الجثث في شكل يومي في العاصمة بغداد يتراوح بين 8 الى 10 جثث غالبيتها لنساء «لكن لا يمكن تحديد هويتها إما لعدم وجود مستمسك يدل عليها أو لتعرضها للتشويه».
يؤكد تلك الحقيقة شرطي، رفض الكشف عن هويته «الصراعات وتصفية الحسابات بين الأطراف المسلحة، تستهدف الرجال عادة، لكن نلاحظ ان عدداً كبيراً من الجثث التي نعثر عليها تعود لنساء».
يقول شرطي آخر في مركز شرطة الزعفرانية، متحدثاً عن إجراءاتهم «ضابط التحقيق يقوم بفتح ملف لمعرفة ملابسات الجريمة فور العثور على الجثة، وفي حال قام شخص بتقديم شكوى ضد شخص ما واتهمه بالوقوف وراءها، يصدر ضابط التحقيق مذكرة قبض بحق المتهم، أما اذا لم تقدّم أي شكوى فيتم تسجيل القضية ضد مجهولين، وهو ما يحدث عادة».
ليست الزعفرانية المنطقة الوحيدة التي يٌعثر فيها على جثث لنساء، وإنما هناك مناطق اخرى في بغداد كحي النصر، والسلام، وحي الأمين، وحي طارق، وسبع البور، والحسينية، والشعب، وحي الجهاد، وحي العامل، وفق الضابط محمود مجدي من شرطة النجدة.
ويردف الضابط مجدي ان «شرطة النجدة لا تستطيع رفع الجثث في المناطق الملتهبة الخارجة عن السيطرة الحكومية، والتي تتكاثر فيها عادة الجماعات الإرهابية، على رغم وجود تبليغات من قبل مواطنين عن وجود جثث».
زار كاتب التحقيق اغلب هذه المناطق، ليكشف على صفات عامة تميزها وهي الفقر الذي يعيش فيه أغلب السكان، بالإضافة الى سيطرة النظام العشائري، حيث لا يتم الاحتكام للقانون.
الطب العدلي ينفي
ينفي مدير عام دائرة الطب العدلي في العراق زيد علي عباس، وجود تلاعب بشهادات الوفاة او تعرضهم لضغوطات عشائرية لتزويرها، يقول: «الأقاويل التي تتحدث عن وجود تلاعب بشهادات وفاة الجثث المجهولة الهوية غير صحيحة كون الطب العدلي لا يحق له تشخيص نوع الجريمة في شهادة الوفاة وإنما وظيفته الأساسية تشخيص الأسباب العلمية والطبية للوفاة».
ويوضح ان «تقرير الطب العدلي يرفع الى القاضي والأخير يعتمده بتشخيص الجريمة مثلما يعتمد ملف المحقق الموجود في محل الحادث وإفادة شهود العيان»، مشيراً الى ان تقرير الطب العدلي هو عبارة عن «حلقة من الحلقات التي تكشف أسباب الجرائم وتثبت الاعتداء الجنسي وبصمة المشتبه به». لكنه لم ينفِ في نفس الوقت أن «الطب العدلي يتسلم جثة او جثتين في اليوم الواحد وفي بعض الأحيان تكون لنساء تم قتلهن تحت مسمى (غسل العار)».
موقف مدير عام دائرة الطب العدلي يتناقض مع ما أعلنت عنه قناة «العراقية» شبه الرسمية، ليلة 11 شباط(فبراير) 2017 على شاشتها، حيث افادت بقيام جماعة مسلحة بتهديد اطباء مستشفيات دائرة صحة بغداد لإجبارهم على اصدار شهادات وفاة مزورة.
غياب الإدعاء العام
العضو السابق في المفوضية العليا لحقوق الإنسان في العراق، بشرى العبيدي، أكدت تلقيها 10 اخبارات عن تلاعبات في شهادات الوفاة، لكنها غير مكتوبة، لأن المخبرين يخافون من الملاحقات العشائرية والقانونية، معربة عن اسفها لعدم قيام فريق تقصي الحقائق في المفوضية بتأدية واجبه بهذا الخصوص.
وتوضح العبيدي ان تسجيل عمليات قتل النساء على اساس انتحار او اي سبب آخر بما يخفي آثار الجريمة، هو أمر مخالف لقانون أصول المحاكمات الجزائية، مشيرة الى ان الجهات القضائية «تتحمل مسؤولية مثل هكذا تزوير».
واستغربت من عدم تحرك «المدعي العام» لتفعيل دعاوى تعاقب الجناة المسؤولين عن قتل النساء، حتى وإن لم تقدم شكاوى في هذا الصدد، بخاصة وأن «جرائم القتل وجرائم الحياء وجرائم الإذاء الشديد لا تحتاج الى شكوى لتحريكها، فحتى لو تنازل ذوو المجني عليه يبقى الحق العام قائماً، ولابد من عرض ملف الجاني بشكل كامل على المحكمة».
وبيّنت العبيدي ان «العثور على جثث نساء في المناطق النائية يعود لأنها مناطق مسيطر عليها من قبل العشائر ويسود فيها الجهل، كما أنها بعيدة عن عين الجهاز الشرطوي، بينما في المدينة يخاف الجانون من رمي الجثث، خشية من القانون ودور منظمات المجتمع المدني والنشطاء في مجال حقوق الإنسان».
مفوضية حقوق الإنسان
وعن دور مفوضية حقوق الإنسان في الكشف عن التلاعبات في شهادات الوفاة بخصوص جرائم الشرف، تقول العبيدي إن غالبية اعضاء المفوضية غير مستقلين وتابعين الى احزاب «بالتالي فإن أي قضية يكون فيها مساس لحزب معين، او تصب بمصلحة جانب سياسي على حساب جانب آخر، لا يقوم احد منا بتحريكها، هذا الى جانب غياب الدراية لدى الأعضاء بحقوق الإنسان».
حاول كاتب التحقيق الحصول على رد رسمي من فريق تقصي الحقائق في المفوضية حول اسباب عدم التحقيق في الشكاوى التي تصل للمفوضية ولكنه قوبل بالرفض، بحجة عدم تقديمه لترخيص لذلك، الا ان عنصراً في الفريق، طلب عدم ذكر اسمه، اوضح له أن «العشرات من الشكاوى تصل الى المكتب وهناك تعمد بعدم التحرك للبحث فيها بحجة عدم وجود تمويل مالي لتغطية نفقات العمل»، رافضاً ذكر أسماء الأحزاب او الجهات السياسية التي تفرض سيطرتها على المفوضية.
وأوضحت هناء ادور، رئيسة جمعية الأمل، وهي واحدة من الجمعيات التي تدافع عن حقوق المرأة أن هناك مطالب مقدمة للبرلمان من قبل مجموعة من المنظمات لتشريع قانون مناهضة العنف الأسري «بغرض التشديد في العقوبات المتعلقة بجرائم الشرف».
أدور عبرت عن أسفها لوجود ما وصفته «بمحاولات لعرقلة مرور القانون من قبل الأحزاب السياسية الموجودة في السلطة».
تطبيق القانون
يرى استاذ علم الاجتماع في جامعة بغداد، خالد حنتوش، ان جرائم الشرف موجودة منذ القدم في العراق «وهي وليدة ثقافة تحتقر المرٲة وتمارس العنف ضدها».
ويوضح أن الحياة الحضرية المدنية في بغداد اليوم «تعاني من تأثير الأعراف والقيم الريفية بشكل كبير، نتيجة عمليات النزوح المتكررة الى العاصمة، اذ دخلت هذه الأعراف وتغلغلت بكل مجالات الحياة حتى باتت تهدد كل ما هو مدني ومتحضر فيها».
لذلك يدعو حنتوش إلى تفعيل الإجراءات القانونية في جرائم غسل العار «بخاصة أن أهل الضحية هم المتهمون بشكل أساسي في حالة الاستدلال على هويتها، بالإضافة الى مراقبة عمل الطب العدلي ودوره في فحص الهوية وكيفية القتل ومتابعة من قام بالتبليغ عن اختفاء احدى قريباته وربط الموضوع بجثث المقتولات».
ينبه المحامي رؤوف محمد نوري، الى جانب آخر من الجرائم المرتبطة بقتل النساء «الشخص الذي يرتكب جريمة قتل تحت مسمى غسل العار، يحاكم وفق قانون العقوبات العراقي المرقم 111 الصادر سنة 1969 في المادة 409 والذي ينص انه (يعاقب بالحبس مدة لا تزيد على ثلاث سنوات من فاجأ زوجته او احد محارمه في حالة تلبسها بالزنا او وجودها في فراش واحد مع شريكها فقتلهما في الحال او قتل احدهما او اعتدى عليهما او على احدهما اعتداءً افضى الى الموت او الى عاهة مستديمة ولا يجوز استعمال حــق الدفاع الشرعـــي ضـــد مــن يـستفــيـد مـــن هـــذا العذر ولا تـطبـق ضـده احكام الظــروف المشددة)».
واضاف ان «هذه المادة اعطت الحق للرجل دون المرأة بالقتل على رغم تساويهما في الحقوق والواجبات في الدستور العراقي».
وسط ظروف الحرب، وفي ظل تصاعد قوة العشائر وضعف سلطة القانون والقضاء، واهمال المؤسسات الحكومية وعجز المنظمات المعنية بقضايا المرأة، وغياب دور الادعاء العام ومفوضية حقوق الانسان، فإن جرائم قتل النساء وتسجيلها كحالات وفاة عادية، ستتصاعد، وضحاياها سيتحولن الى مجرد حكايات في مجالس العزاء، فيما الجناة يتحولون الى ابطال في عشائرهم.
