ثلث المتزوجات في العراق قاصرات
الخوف والفقر والتقاليد والثغرات في القانون ترفع معدلات الزواج المبكر
في يوم تموزي لاهب عام 2015، ودعت هدى ذات الثلاثة عشر عاما عائلتها في مخيم الخازر للنازحين شرقي الموصل “أملاً بحياة جديدة خارج أسوار مقبرة الأحياء” كما تصفها. كان الفرح يمتزج بالخوف، فرحة الخلاص من الفقر واليأس الكامن في حياة بمخيم يفتقر للخدمات ويحشر في كل خيمة فيه عائلة كاملة “وخوف الزواج بشخص مجهول يكبرها بعشرين عاما”.
في ذات المخيم، خلال نحو شهر زُوِجت أربع فتيات قُصر، رصدها كاتب التحقيق، وتكرر المشهد ذاته وفق حالات رصد لمنظمات ومشاهدات لصحفيين، في نحو 20 مخيما آخر بنيت جميعا على نحو عاجل في محافظتي دهوك واربيل وشمالي وشرقي محافظة نينوى التي استولى عليها تنظيم داعش واعلن فيها دولته، والتي استقبلت بين منتصف 2014 ونهاية 2016 مئات آلاف النازحين الهاربين من التنظيم.
فتيات دون الخامسة عشر أجبرن جميعا، في ساعات عجز وفوضى وحرب، على مغادرة عالم الطفولة واللعب والأحلام تحت تهديد الفقر والخوف من المستقبل، الى عالم الكبار بمسؤولياته ومتطلباته، في ظل تقاليد مجتمعية لا تمنحهن حق الاعتراض، ومع غياب التشريعات الرادعة والمؤسسات المتدخلة.
تقول هدى وهي تحمل على صدرها طفلتها ذات الأشهر الثلاثة محاولة تهدأتها بعد موجة بكاء اثر معاناتها من التهابات في الفم “بعد نزوحنا من الموصل هربا من داعش وعقب اشهر من حياة مذلة بين العوز والمرض في المخيم وجدت في الزواج فرصة للخلاص من تلك الحياة وتخفيف العبء على عائلتي”.
دون تأخير قبلت بأول رجل تقدم لها، حتى قبل أن تعرفه وتسأل عنه، لمجرد انه كان يملك بيتا ومتجرا يدر عليه دخلاً متوسطاً. وهو ما فعلته آلاف غيرها من النازحات.
تردف ” لم يكن أمامي خيار آخر، وسط عائلة تضم تسعة افراد ولا تملك أي مصدر دخل”.
سنة وشهران فقط كان عمر ذلك الزواج، فضلت هدى بعدها الطلاق والعودة الى المخيم مع رضيعة تنتظر الرعاية، على “قسوة” زوجها و”جحيم عائلته”، متنازلة عن كل حقوقها الشرعية. تقول “لم اعرف ان الحياة مع زوج يكبرني بعشرين عاماً، ويعتبرني عبدة له، أسوأ ألف مرة من قسوة الحياة بمخيم النزوح”.
في ذات الشهر الذي تزوجت فيه هدى، تم تزويج زميلتها هند، التي لم تكن قد أكملت الخامسة عشر والتي انقطعت أخبارها طوال أشهر بعد أن منعت من الخروج والتحدث بالهاتف، قبل أن تهرب ذات مساء من منزل زوجها وتعود الى عائلتها ضيفة ثقيلة تطاردها “التعليقات والنصائح”، فهي امرأة مهددة بالطلاق، بلا تعليم ولا فرصة للعمل، ولا تملك خيارا غير “الخضوع للواقع والعودة لزوجها”.
تقول “كنت اشعر اني مختطفة، اتساءل في اليوم مائة مرة هل اهرب عائدة لعائلتي التي باعتني، أم اواصل حياتي كعبدة مطيعة لغرائز شخص يكبرني ويعاملني مع زوجته الأولى كجارية، رجل لا أكن له اي مودة، وضعتني تسوية مالية اجتماعية تحت رحمته”.
بحسب ناشطين في مجال حقوق النساء والأطفال، هناك عشرات الآلاف من ضحايا الزواج المبكر في مختلف مناطق البلاد، وهو ما تؤكده الأرقام الرسمية ايضا.
ثلث المتزوجات قاصرات
كشف الجهاز المركزي للإحصاء في عام 2011 أن 5.4 % من الفتيات العراقيات تزوَّجن بعمر دون 15 سنة، ونحو 23% دون 18 سنة، فيما أظهر المسح الاجتماعي والاقتصادي للأسرة في العراق لوزارة التخطيط للعام 2007، أن21% من الفتيات تزوجّن قبل اكمالهن لسن الـ19سنة، مقارنة بـ15% ما بين الاعوام 1997 و2004 حين كان العراق يخضع لعقوبات اقتصادية قاسية.
في العام 2013 ذكرت وزارة التخطيط ان 11% من حالات الزواج التي جرت داخل المحاكم تندرج في خانة زواج القاصرات. مع وجود نسب أكبر تسجل خارج المحاكم. وقال وزير التخطيط والتعاون الانمائي علي الشكري في تموز 2013 خلال الاحتفال باليوم العالمي للسكان ان 5.5% من النساء المتزوجات تزوجن قبل سن 15 عاما، 23.4% تزوجن قبل سن 18 عاما”.
تلك الأرقام المعلنة قبل احتلال تنظيم داعش لمناطق واسعة من البلاد ونزوح أكثر من ثلاثة ملايين انسان من ديارهم وقبل استفحال الأزمة الاقتصادية في البلاد نتيجة تراجع سعر برميل النفط في الأسواق العالمية ومعه موارد البلاد، لم تتبعها احصاءات رسمية حديثة، فالجهات المعنية بما فيها وزارة التخطيط ومجلس القضاء الأعلى ولجنة المرأة والطفل في البرلمان العراقي، تؤكد عدم امتلاكها لأية ارقام جديدة.
يقول مسؤول اعلام وزارة التخطيط عبد الزهرة الهنداوي، ان الوزارة لا تملك فعليا أية احصائية لزواج القاصرات ولا لنسب طلاقهن من مجموع المطلقات. وبدوره يؤكد الناطق باسم مجلس القضاء الأعلى القاضي عبد الستار البيرقردار عدم امتلاكهم لاحصائية عن زواج القاصرات “لأن زواج القاصرات دائما يحصل خارج المحاكم عند رجل الدين، كون القانون الحالي يمنع زواج القاصرات”.
الكلام ذاته كررته لجنة المرأة والطفل بالبرلمان العراقي، مذكرة ان كشف تلك الأرقام من مسؤولية وزارة التخطيط.
وسط غياب الأرقام الرسمية تؤكد منظمات معنية بحقوق النساء مثل جمعية نساء بغداد ومنظمة ليديا، وباحثون اكاديميون من خلال دراسات ميدانية اجريت في السنوات الخمس الأخيرة اعتمدت مسوحات واستطلاعات في محاكم محددة ببغداد ان معدلات زواج القاصرات تتصاعد وان أكثر من ثلث المتزوجات هن قاصرات والفئة الأكبر هي بين 15 الى 17 عاما.
وتنبه الناشطة في مجال حقوق المرأة فيان احمد، الى ان معدلات زواج القاصرات في مدن جنوب البلاد تسجل ارقام اعلى بسبب ارتفاع معدلات الفقر (نحو 30%) وترك الدراسة وندرة فرص العمل الى جانب العادات والتقاليد العشائرية، كما ترتفع في المناطق التي شهدت عمليات عنف ونزوح كنينوى وصلاح الدين والانبار “هناك عوائل تفضل تزويج الفتيات على تحمل مسؤوليتهن”.
لا يختلف المشهد كثيرا في اقليم كردستان حيث الأوضاع الاقتصادية والأمنية افضل، ففي السنوات الثلاث الماضية كانت 30% من حالات الزواج للفئة العمرية 15 الى 20 عاما، وفق نتائج بحوث ميدانية اجرتها منظمة ليديا وعرضتها في جلسة نقاشية.
وتشير عضو لجنة المرأة والطفولة النيابية، النائبة ريزان شيخ دلير، الى غياب الإحصاءات الدقيقة كون معظم الزيجات تعقد خارج المحاكم، وتستدرك “إلا أن هناك أرقاما مخيفة عن عدد القاصرات اللواتي يتم تزويجهن في أعمار صغيرة… في مناطق انتشار النازحين أغلب الزيجات تتم خارج المحاكم، البعض يتم تزويجهن بعمر تسع سنوات”.
الثغرات القانونية
يحدث ذلك في ظل قانون للأحوال الشخصية يتيح زواج القاصرات بوجود ثغرات فيه او نتيجة خلل في التطبيقات القضائية تسمح بتسجيل عقود الزواج المبرمة خارج المحاكم لاحقا في المحاكم.
تؤكد الخبيرة القانونية والناشطة الحقوقية رجاء رحمة، ان العديد من الثغرات في القوانين يتم استغلالها لتمرير حالات زواج القاصرات امام محاكم الأحوال الشخصية، حتى ان بعض المحامين تخصصوا في هذا المجال.
“انها كارثة ولا أحد يبحث عن حل.. فتيات صغيرات يجبرن على الزواج لتتحول أحلامهن بعد حين الى كوابيس في ظل عوائل مفككة… تكاد تجد في كل حي سكني قاصرات متزوجات وحياتهن مهددة، والنتيجة ارتفاع معدلات الطلاق بشكل مخيف”.
قانون الأحوال الشخصية العراقي رقم 188 لسنة 1959 المعدل اشترط اكمال الثامنة عشر عاما للزواج في المادة 7 الفقرة 1، الا ان المادة 8 من ذات القانون في الفقرة 1 و 2 (التي تنص على 1 – اذا طلب من اكمل الخامسة عشرة من العمر الزواج فللقاضي ان ياذن به اذا ثبت له اهليته وقابليته البدنية بعد موافقة وليه الشرعي فاذا امتنع الولي طلب القاضي منه موافقته خلال مدة يحددها له، فان لم يعترض او كان اعتراضه غير جدير بالاعتبار اذن القاضي بالزواج. 2 – للقاضي ان ياذن بزواج من بلغ الخامسة عشر من العمر اذا وجد ضرورة قصوى تدعو الى ذلك، ويشترط لاعطاء الاذن تحقق البلوغ الشرعي والقابلية البدنية) ترك ثغرة واضحة لامكانية الزواج تحت سن الثامنة عشر، كما تقول رحمة.
هذه “الثغرات” مع العديد من حالات الخلل في التطبيقات القضائية تتسبب في استمرار زواج القاصرات وتصديقه من قبل محاكم الأحوال الشخصية.
خلل بالتطبيقات القضائية
الاجراءات الواجب اتباعها في عقد الزواج بشكل عام “أصبحت اشبه بالروتين عند القضاة ويرددونها وكأنها تحصيل حاصل”، تقول المحامية دنيا الربيعي “سؤال الفتاة عن قبولها بالزواج يتم بطريقة رويتنية، فالقاضي يسألها بشكل لا يستفهم منها انما فقط يردد الكلام وينتظر الجواب المعروف، وعادة يسأل وهو يكتب في الأوراق دون النظر الى وجهها لقراءة تعابيره التي ربما تظهر اجبارها على القبول.. معظم القضاة يرون ان مجيء الفتاة الى المحكمة يعني قبولها بالزواج”.
هكذا تجري جميع الاجراءات، منها الاذن بالزواج للقاصر، كما حدث مع ليلى ذات 16 سنة التي تسكن بغداد، عندما قدم والدها طلبا للقاضي بمحكمة الأحوال الشخصية، يقضي باكتمال أهليتها الشرعية وطلب الاذن لها بالزواج.
تقول ليلى “اكتفى القاضي بمطالعة الطلب الذي ارفقت معه شهادة من رجل دين، ولم يوجه لي اي سؤال” وبموجب قبول الطلب “تم تزويجي من رجل يكبرني بـ 23 سنة دون معرفة رأيي.. لقد اعتبروني موافقة.. هكذا وأنا مقيدة بخوفي ومرتعبة من مستقبلي، ارغمت على الزواج في ظل ذلك القانون وأمام قاضي حسم الامر في دقيقتين وباجراءات روتينية”.
يقول المحامي سليم الدراجي، الذي يتابع قضايا الأحوال الشخصية ان “القاضي في هذه الحالة استند الى المادة 8 الفقرة 1 من قانون الأحوال الشخصية والتي تجيز للقاضي تزويج القاصر اذا ما ثبت اهليته وقدرته البدنية، واعتبر شهادة رجل الدين دليلا على ذلك، كما اعتبر تقديم الوالد للطلب موافقة على الزواج، دون معرفة رأي القاصر نفسها”.
ويؤكد الدراجي إن “هذا يعتبر خللا واضحا في تطبيق القاضي للقانون الذي اصلا فيه خلل”، موضحا ان المادة المذكورة “تشترط تقدم القاصر نفسه بالطلب فيجب على القاضي التأكد من ان القاصر هو من يطلب”.
الزواج خارج المحاكم
أحد مفاصل الخلل التي تتيح زواج القاصرات، هو الزواج عند رجال الدين خارج المحاكم في ما تعرف بالمكاتب الشرعية، وهو أمر متاح وشائع في ظل عقوبة لم يعد لها وجود على ارض الواقع، على ان يتم تصديق الزواج لاحقا في المحاكم.
فالمادة 10 الفقرة 5 الخاصة بعقوبة الزواج خارج المحاكم تنص على (يعاقب بالحبس مدة لا تقل عن ستة اشهر ولا تزيد على سنة او بغرامة لا تقل عن ثلاثمائة دينار ولا تزيد على الف دينار كل رجل عقد زواج خارج المحكمة وتكون العقوبة الحبس مدة لا تقل عن ثلاث سنوات ولا تزيد عن خمس سنوات اذا عقد خارج المحكمة زواجا آخر مع قيام الزوجية).
ومع التراخي في تطبيق العقوبة، حيث يؤخذ عادة بأخف عقوبة وهي الغرامة التي لا تزيد على 1000 دينار (أقل من دولار واحد) يصبح الزواج خارج المحاكم بكل ما يحمله من محاذير أمراً متاحاً ومخرجا ميسرا لزواج القاصرات.
تقول المحامية رحمة، ان أحد القضاة اضطر قبل أيام لتزويج فتاة قاصر بعمر ثلاثة عشر عاما من شاب في الثامنة عشر، لمجرد انهما قاما بإجراء الزواج الشرعي لدى رجل الدين، ومثل هذه الحالات تتكرر بشكل كبير في المحاكم وهو ما يعتبر فرض الأمر الواقع.
الأمر لا يتعلق بحالات فردية، بل بعشرات آلاف الحالات في عموم البلاد، فقد سجل نحو 9800 حالة زواج خارج المحاكم في بغداد وحدها خلال 2017، وفق أرقام مجلس القضاء، بينما سجل نحو 59 الف حالة في عموم العراق عدا اقليم كردستان، جزء كبير منها يتمثل بزواج قاصرات تريد عوائلهن فرض الأمر الواقع على المحاكم.
هكذا تم تزويج سارة، التي كانت في الخامسة عشر من عمرها، وتعيش بمنطقة الشعلة ببغداد، حيث قدم ما يثبت زواجها خارج المحكمة. أبلغت سارة صديقتها في المدرسة الاعدادية التي تحدثت الى معد التحقيق “ذات يوم غابت عن المدرسة، وحين اتصلت بها قالت انها اجبرت على الزواج، ولا احد يستطيع انقاذها”.
تشريع قانون جديد
ورغم تلك الثغرات التي تتيح زواج القاصرات، فان القانون الحالي يعتبر مقبولا، مقارنة بمسودة قانون سعى نواب الى تمريره في الدورة المنتهية كان سيفتح الباب واسعا أمام زواج القاصرات، في محاولة هي الثالثة منذ 2003.
تقول الناشطة في قضايا المرأة سعاد قاسم “لا نعرف كيف يمكننا وقف تلك الجريمة بحق اطفال بلا وعي وبحق فتيات قاصرات بلا ارادة يخضعن لقرار عوائلهن، والنتيجة زواج فاشل في كثير من الأحيان أو طلاق في ظل مجتمع لا يرحم المطلقات”.
وتضيف “الأمر لا يتعلق فقط بالأهلية البدنية، بل الوعي بما يعنيه الزواج، وبالقدرة على اتخاذ قرار سيحدد مصيرك ويرسم خط حياتك المستقبلي الذي يصعب عليك ان تغيره لاحقا؟”.
وتساءلت “هل النائبات اللواتي دعمن ذلك التشريع، بدعوى منح الفتاة حق الاختيار في بناء عائلة والتمتع بالحياة الزوجية، مستعدات لتزويج بناتهن وهن في اعمار 9 او 16 سنة؟”.
اضافة الى الثغرات القانونية والاشكالات القضائية، هناك جوانب اخرى لظاهرة زواح القاصرات، تتمثل بالتقاليد العشائرية والنصوص الدينية التي تعد فيصلا في موضوع زواج الفتاة، وغالبا ما ينصاع القانون والقضاء لها من خلال ايجاد طرق لعدم مواجهته، بحسب دنيا الربيعي.
تداخل الدين والعادات
اختلفت المذاهب الفقهية في تحديد العمر المسموح للفتاة بالزواج، فمنها من يذهب الى عمر 9 سنوات واخرى الى 13 او 15 سنة، وهذا ما يفتح الباب أمام زواج القاصرات ويعطي مجالا واسعا للتأويلات بشأن السن الشرعي للزواج دون الأخذ بتبدل الواقع.
تقول الناشطة النسوية ابتهال جاسم ان السبب الأول لزواج القاصرات يتمثل في الموروث الاجتماعي والعشائري “المغلف بالإطار الديني والشرعي”، مبينة ان الطابع العشائري والذكوري للمجتمع العراقي “اتخذ من الدين اطارا له لتمرير كلما يصب في ترسيخ هذا الموروث”.
يقول رجل الدين، الشيخ ابو قيصر الجبوري، من سكنة الحسينية ببغداد وهي من المناطق الشعبية، ان هذه العادات “سنينة” عشائرية وهي تشجع زواج البنات بعمر صغير لأسباب عديدة بينهما ما يتعلق بالتماسك الاجتماعي، مبينا أن أحد أسباب ترسخ هذه التقاليد يتمثل في “ابعاد الشاب والفتاة عن الحرام (العلاقات غير الشرعية) ولزيادة النسل فالبنت التي تتزوج من الصغر تنجب اكثر وتزيد من عدد افراد العائلة”.
ويوضح الشيخ احمد حسن المفتي، موقف الشرع، قائلا ان “الشرع باختلاف المذاهب الفقهية اقر جواز زواج الفتاة قبل الثامنة عشر عاما، أي هو جائز وليس فرض”، مبينا ان الجواز يعني ان هذا الأمر مسموح ما لم يكن فيه ضرر ناتج عن حالة خاصة “كأن تكون ناعمة (صغيرة الجسم) او تكون غير واعية وناضجة فكريا”.
لكن الشيخ جاسم المندلاوي، يشدد على ضرورة تصدي رجال الدين لهذه الظاهرة من خلال شرح وتوضيح “العناوين الثانوية الشرعية ضمن قاعدة لا ضرر ولا ضرار”، مبينا ان زواج القاصرة “اذا ادى الى انهيار الوضع الأسري فهو حرام”. ويؤكد ان “اجبار البنت القاصر على الزواج حرام، ويجعل عقد زواجها باطلا”.
الهروب من الفقر
يعد الفقر الذي بلغت نسبته نحو 23% في العام 2014 بحسب ارقام وزارة التخطيط، وأكثر من 30% بحسب نواب، أهم اسباب الزواج المبكر، ومع نزوح أكثر من ثلاثة ملايين شخص عن مناطقهم، نتيجة الحرب مع تنظيم داعش، تشكلت بيئة مشجعة لزواج القاصرات.
تقول الباحثة الاجتماعية لمياء الجواري “بعض العوائل اضطرت الى تزويج بناتها رغم صغر سنهن تحت ضغط عدم قدرتهم على تحمل تكاليف معيشتهن وتعليمهن” وهو ما زاد من معدلات زواج القاصرات وطلاقهن لاحقا.
الجواري رصدت خلال عملها في بحث ميداني بمحكمة الأحوال الشخصية بالموصل اكثر من 40 حالة طلاق خلال ثلاثة اشهر لقاصرات بينها 35 حالة كان سوء الوضع المعيشي هو الدافع وراء الزواج “خاصة وان الشرع يبيح ذلك فهو ليس بعيب ولا حرام كما يرددون”.
هذا ما ما دفع صباح ذات الأربعة عشر عاما الى الطلاق بعد ستة اشهر من زواج تصفه والدتها “بالتجربة المرة” التي عاشتها حين حاولت “الهروب من الفقر”.
بوجه شاحب وملابس نسائية فضفاضة لم تخف طفولتها، كانت تقف أمام باب محكمة الموصل للأحوال الشخصية في انتظار دورها لاكمال معاملتها، قالت وهي تتكأ على حائط صغير “لم تستطع والدتي الأرملة إعالة اربعة اطفال في مخيم بحركة في ضواحي اربيل بعد نزوحنا من الموصل”.
وأضافت وهي تنظر الى الأرض وتحاول اخفاء وجهها باوراق دعوى الطلاق التي كانت تحملها “بعد معاناة وعمل في البيوت قررت تزويجي، وتم كل شيء خلال أيام”.
النائبة ريزان شيخ دلير، أكدت أن مجلس النواب مطلع تماما على ما يجري في مخيمات النزوح “تتعرض النازحات الى الاتجار والزواج القسري والمبكر وفق نتائج الزيارات الميدانية”. واشارت الى تعرض “نحو 30% من نساء أحد مخيمات كردستان (لم تكشف اسم المخيم) إلى الاتجار والزواج القسري والمبكر، دون وجود متابعة ميدانية لأوضاعهم”.
الخوف من المستقبل
يضاف الى الفقر كدافع أساسي لزواج القاصرات، عامل الخوف من المستقبل، وهو ما عانى منه الايزيديون بعد ما تعرضوا له في آب 2014 من عمليات ابادة وسبي على يد تنظيم الدولة الاسلامية، حيث وجد اكثر من 300 الف ايزيدي انفسهم في مخيمات النزوح فيما وقعت أكثر من ثلاثة آلاف امرأة وفتاة اسيرة بيد التنظيم الذي حولهن الى سبايا مازال مصير اكثر من الفين منهن مجهولا، بحسب ارقام دائرة الأوقاف الايزيدية، وهو ما دفع بآلاف الايزيديين للاسراع في تزويج بناتهم.
الناشط في مجال حقوق الايزيديين احسان عبد الله، أكد حصول مئات من حالات زواج القاصرات في مخيمات النزوح التي زاروها بعد “الابادة”، قائلا ان عملية عقد القران كانت تتم على يد رجال دين دون اي مظاهر لمراسم الزواج. ولاحقا جرت عمليات تسجيل للزواج في الاوراق الرسمية للمحاكم.
“كان يحدث كل شيء خلال ساعات، وتنتقل الفتاة القاصر من خمية عائلتها الى خيمة زوجها المجاورة.
هكذا تزوجت أميرة في ايلول 2014، حين كانت في السادسة عشر من عمرها، وهاجر زوجها الى المانيا بعد اسابيع من الزواج.
تقول “لم يحصل على لجوء بعد، منذ أكثر من ثلاث سنوات أنا انتظره وربما سيتطلب الامر سنوات أخرى قبل ان التحق به… حقيقة لا اعرف أي معنى لزواجي، وأخشى ان يتزوج بأخرى… الحمد لله اني لم ارزق بطفل كصديقتي، كان الأمر سيصبح كارثيا”.
مخاطر صحية
الزيجات الإجبارية تحت حكم الفقر والخوف والظروف الطارئة او المساومات المالية، تعاني في الغالب من التفكك بغياب الانسجام بين الزوحين، وتظل مهددة بالانهيار خاصة في ظل الانفتاح الاجتماعي. “انها منبع للمشاكل الاجتماعية، واذا ما كان هناك أطفال فان الأمر يصبح أعقد فهؤلاء كما الأبوين يتحولون الى ضحايا، فضلا عن الكثير من المشاكل الصحية” تقول الباحثة الاجتماعية ابتهال جاسم.
وترى جاسم ان خط حياة زواج القاصر يظل مضطربا تغلفه المعاناة ويهدده الطلاق خاصة في حال كون الزوج مسناً “المشاكل بسبب عدم التكافؤ تظهر سريعا، فالزوجة القاصر لا تفهم مسؤوليات الزواج كونها ما تزال تعيش بعقل طفولي غير ناضج، واذا ما تقبلت الزوجة حياتها وتحملت تلك المشاكل وتجاوزتها، فانها تجد نفسها بعد نضوجها برفقة زوج مسن لا يلبي احتياجاتها كزوجة شابة ولا يفهم تصرفاتها كفتاة في مقتبل العمر”.
لا تقتصر النتائج السلبية لزواج القاصرات على الجوانب الاجتماعية، وانما قد يحمل مشاكل صحية للزوجة مثل تمزق الرحم واختناق الجنين بسبب انخفاض ضغط الدم، بحسب الدكتورة النسائية سمية محمد.
وتنبه محمد الى ان بنية الكثير من الفتيات قبل بلوغ الـ18 عاما “غير مهيئة للزواج او الحمل، لذلك تتعرض الزوجة القاصر الى العديد من المشاكل التي قد تؤدي الى وفاتها او وفاة الجنين في بعض الحالات”، مؤكدة ان مستشفيات الولادة تشهد العديد من هذه الحالات التي يتم اخفاؤها بسبب العادات والتقاليد.
ولا تقتصر المخاطر على فترة الولادة “اذا نجت الأم والطفل، فان هناك احتمالا كبيرا لتعرض الطفل الى مشاكل صحية في المستقبل لعدم حصوله على حاضنة مكتملة في فترة الحمل”.
وتحذر المنظمات المعنية بقضايا المرأة من أن «النساء بين أعمار 15 إلى 18 عاما هنّ أكثر عرضة للوفاة أثناء الحمل أو الولادة بمرتين بالقياس إلى النساء اللاتي تتراوح أعمارهن بين 20 و24 سنة»، مبينة ان حمل القاصرات هي قضية تتقاطع مع تنمية المرأة بسبب الانقطاع المبكر عن التعليم وانعدام فرص كسب المؤهلات الأساسية للعمل بالنسبة للأمهات الشابات.
اليافعات المطلقات
تقول ليلى حسن، وهي ناشطة مدنية مهتمة بحقوق الأطفال، ان قصص الفتيات الصغيرات اللواتي يعشن مع معاناتهن بصمت او يواجهن الطلاق او حتى يقدمن على الانتحار، تسمعها في كل مكان، فعقب عقود من العنف وتراجع التعليم واستمرار معدلات الفقر العالية اصبح الزواج المبكر ظاهرة ومعها تصاعدت معدلات الطلاق التي تمثل بحد ذاتها مشكلة كبيرة في ظل تقاليد اجتماعية قاسية وغياب للاستقلالية الاقتصادية يصعب معها على المطلقة “الفوز بفرصة زواج ثانية” أو بناء حياة مستقرة ما يحولها الى أسيرة في المنزل وخادمة لأخوتها.
وكان مجلس القضاء الأعلى قد أعلن أن حالات الطلاق المثبتة في المحاكم خلال 2017 تجاوزت 70 ألفا مقابل 321 الف حالة زواج (نحو 22%) عدا محافظات الاقليم، وبواقع 195 حالة طلاق يوميا، بينما كانت في العام 2015 نحو 52 الفا وفي العام 2016 56 ألفا. وتقول السلطة القضائية الاتحادية أن الأرقام تتصاعد منذ 2014 وأغلب حالات الطلاق تحدث خارج المحاكم.
وتم بين 2004 ونهاية 2017 تسجيل نحو 695 الف حالة طلاق. وسجلت نحو 517 ألف حالة خلال الأعوام من 2004 – 2014، في وقت كان مجموع حالات الزواج خلال نفس المدة نحو 2 مليون و624 ألف حالة، ما يعني أن حوالي 20% من هذه الزيجات انتهت بالطلاق.
ويؤكد محامون يتابعون دعاوى الطلاق أن أكثر من نصف حالات الطلاق تحدث بين القاصرين ومن هم في العشرينات. يقول المحامي قيس يحيى الذي يتلقى مكتبه اسبوعيا العديد من دعاوى الطلاق “بين كل عشر دعاوى طلاق تجد ستة منها لمن هم في العشرينات او من القاصرين”. وينقل محامون ارقام مقاربة، فيما تكتفي المنظمات المعنية بحقوق النساء بتأكيد تصاعد معدلات زواج القاصرات، دون اعطاء معدلات محددة.
ولا تعطي الأجهزة الحكومية ارقام بنسب القاصرات المطلقات من مجموع المطلقات، لكن وفق إحصائية رسمية فان محاكم الأحوال الشخصية في محافظة بابل، وسط العراق، شهدت تسجيل 12662 طلاقا للفئات بين (15-30) عاماً مقابل 89878 زواجاً خلال الأعوام الأربعة الأخيرة.
واعتمادا على مخرجات دراسات بحثية من جامعة بغداد وأخرى ميدانية عن حالات الطلاق، اطلع عليها معد التحقيق، فان احد ابرز اسبابها يعود الى الزواج المبكر.
يرى الناشط المدني علي عادل ان مشكلة زواج القاصرات ستظل قائمة وتتعقد أكثر، مالم تتخذ اجراءات رادعة بحق كل من يساهم في تسهيل ذلك النوع من الزواج، سواء من الأهل او رجال دين.
عادل حدد شرطا أساسيا لوقف الظاهرة المتسعة ويتمثل “بمعالجة الثغرات في قانون الأحوال الشخصية الحالي، واقرار البرلمان لتشريعات رادعة بحق كل من يساعد على عقد هكذا زيجات”، معتبرا أن ذلك يشكل الخطوة الاولى لحل هذه المشكلة، أما المضي بالاتجاه المعاكس فسيحمل نتائج كارثية تؤثر على استقرار المجتمع.
الى جانب ذلك تدعو الاعلامية انسجام الغراوي الى إصدار فتوى دينية من مرجع معتمد “بعدم جواز هكذا نوع من الزيجات، وتحريمها”، مشددة على اهمية ذلك بسبب التأثير الحاسم للعامل الديني.
وتطالب الناشطة الهام عبدالله بايقاف عمل المكاتب المختصة بتنظيم عقود الزواج خارج المحاكم، كونها تسهل زواج القاصرات، مشيرة الى رصد حالات لفتيات زوجن لأكثر من مرة قبل ان يبلغن الثامنة عشر عاما، ما يحول بعض الزيجات الى نوع من الاتجار بالبشر.
هدى التي حرمت من طفولتها تجلس كل مساء أمام باب خيمتها مع طفلتها، بعيدا عن بقية النساء، وهي تتطلع الى المكان الذي كان يجمعها قبل عام ونصف مع زميلتها هند التي انقطعت أخبارها مجددا عقب عودتها لزوجها. تقول “حياتي انتهت… كل ما أتمناه تأمين حياة أفضل لابنتي من تلك التي عشتها، وان تتغير القوانين التي تتيح لعوائل الأطفال تزويجهن وتقرير مصيرهن الى الأبد”.
